TITLE I - DEFINITION AND OBJECTIVES OF THE UNION

Article I-1 Establishment of the Union

1. This Second Treaty of Rome establishes the European Union, on which the Member States grant authority to act in the areas laid out in this Constitution. The Union shall coordinate the creation of policies in these areas.

Article I-2 Fundamental rights

1. Fundamental rights, as guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms, are a fundamental principle of the Union's law and that of its Member States. Member States infringing persistently on this fundamental principle can not be part of the Union.

2. The Union guarantees the right of its inhabitants to be treated equally before the Union's law, irrespective of their country of residence.

3. In particular, and subject to paragraphs 1 and 2 of this article, the Union guarantees that its inhabitants enjoy the following rights:

  • to vote and to stand as candidates in elections to the European Parliament;
  • to vote and to stand as candidates in municipal elections anywhere in the Union;
  • to live and to work anywhere in the Union;
  • to buy and sell goods, capital and services anywhere in the Union;

Article I-3 Relations between the Union and the Member States

1. The union shall respect the national identities of member states, inherent in their fundamental structures, political and constitutional, inclusive of regional and local self-government. It shall respect their essential State functions, including ensuring the territorial integrity of the State, maintaining law and order, and safeguarding national security.

2. The Member States shall undertake the measures agreed to in Constitution or resulting from the acts of the institutions of the Union.

Article I-4 Union law

The Constitution and law adopted by the institutions of the Union in exercising authority in its defined areas shall have primacy over the law of the Member States.

Article I-5 Legal personality

The Union shall have legal personality.

Article I-6 The symbols of the Union

The flag of the Union shall be a circle of twelve golden stars on a blue background.

The anthem of the Union shall be based on the ‘Ode to Joy’ from the Ninth Symphony by Ludwig van Beethoven.

The motto of the Union shall be: "Spira, Spera" - Live, Hope.

European history day shall be celebrated on 9 May throughout the Union.
